Am I a scammer?

Hi,

 

so here my story…

 

I sold a watch 4 months ago, that now broke with the new owner. Now the buyer wants a +/- full refund. He says that he never wore, as it is a summer watch.

 

I offered to fix it for him for free, if I could, but he chose to ask a watch smith, that then diagnosed a main spring issue…

 

I offered to buy it back for spares at 30% of the selling price (100USD), which I think is fair… I am not a dealer, so a guarantee or such I cannot give of course… and it is four months with him.

 

He paid via PP gift and has now threatened to “report me” to VISA…

 

Am I a scammer?

I take it you offered warranty OK at delivery??

If it was working when he received it, and then it then subsequently broke, then tough shit - that's the risk any buyer takes..

 

I'd report him to a moderator and let them sort it out!!

Not in my opinion.

You are not a dealer, watch retailer and certainly not a scammer.

Methinks the buyer is trying it on.

4 months late seems a little long for buyers remorse - surely he would have checked

if the watch was working on receipt of it originally - I certainly would.

 

Don't know how far he'll get in a PP/Visa dispute considering the length of time that has elapsed

and the nature of the goods involved.

Does he think VISA is some sort of law enforcement company! What are they going to do?

Mate, I think you've gone well above your obligations as a second hand seller. Notwithstanding the time elapsed, is your attempts to remediate the issue.

 

Afaik, he can't do much with paypal. But not sure about visa.

 

What was quoted at the watchsmith?

Scammer - no way. I would say by gentlemen's agreement that if a watch sold to another member broke after a few days then maybe they could expect a refund but after 4 months no way. How do you know what they have done with it in 4 months? Check up on PayPal rules I am sure this is over any time limits they have. Report you to Visa, no way its 2nd hand goods sold as seen - might as well report you to Pizza Hut!!!

Oh dear - no, of course, you're not the one in the wrong here. If he'd complained within a few days of receiving it then maybe he'd be entitled to send it back, but 4 months later?

 

Frankly, I think you've been extremely generous offering what you already have.

He'll no your not a scammer. Dont take everyone at their word.This guy bought a watch 4 months ago, could have done anything with it in that time, and has come back to you wanting his money back? Lol NO!

 

If he wants a proper warranty with a watch tell him to go by gen, and even if it was gen I'd still tell him where to go.

Of cause you are not a scammer but the buyer is verging on being one.

You however have already gone above and beyond. I would offer him nothing from now on.

Visa will not give two hoots, it was a private sale of second hand goods.

 

Buyer is acting like an AAA++ grade :asshat:

He has ridiculous expectations - you are unfortunately dealing with someone who doesn't understand that sometimes things do not go in your favour ( he's buying a replica watch for the love of god ) and expects someone else to bear the brunt of any risks he takes - in short he's a fucking baby !!!

People like this really annoy me.

I wouldn't even take it back if it came to him DOA (knowing it worked when I sent it ofcourse). These are the risks you take as a 2nd hand buyer, agreed that it would suck, but if you want warranty etc, go buy yourself an invicta for 100$.
