Only advice i can add is call ebay, i was given that advice here and was assured they pay more attention to a call than emails etc, an actual person is better. I was found in favour with my dispute and i called, i was also saved the waiting and wondering what their response to my emails would be, the guy discussed it with me on the phone, i felt much better doing it that way

After having a problem like this a few years ago I always pay by CC through PayPal (not debit card or bank account). That way you have multiple means of recourse.

If you don't know the seller, ALWAYS fund with a credit card.

Today I got a e-mail from eBay:

 

"eBay Customer Support will issue a full refund to you when you ship the item back to the seller with tracking and signature confirmation to the address below. Jul 20, 2011 at 7:32 PM

 

Final decision:

This case was decided in your favor.

eBay Customer Support comments:

We're sorry you had a problem with your purchase. For more information about this case, please refer to the email we sent you."

Send it in a way that he has to pay for the shipping. I believe it's possible.

Yes I had to pay for the shipping. It was about 62$ and it requires him to sign for it when it arrives.

I got 10$ from eBay before I shipped it and afterwards when it returns I'll get full coverage for shipping.

Really sorry to hear this mate. I fucking hate eBay and all the time wasting pricks that seem to congregate there. I generally avoid it these days. Can't remember the last time I sold anything on there. I try and stick to specialist forums these days as much as I can.

 

I sold a set of speakers a few years ago to this fella, and he claimed that his CC had been stolen and the speakers were purchased without his knowledge. Funny how the speakers got sent to his correct address though, and his PayPal account was never reported as hacked. Luckily PayPal quickly saw through his lies and the dispute was resolved in my favour. Many people haven't been so lucky with 'charge-backs'. He's lucky I didn't go pay him a visit with my friend Mr Baseball bat. If I'd not got my money back I'm not sure I would have been so reserved.

what if he refuses to sign and claims to never get the package?

Does tracking info saying undelivered or unsigned counts to get your full refund??

Today I got my refund from eBay. 300$ was moved to my PayPal account.

 

The first thing I did was giving the seller negative feedback. What do you know, next email was from the seller asking this:

 

"Sir why did you leave us a negative?

 

We told ebay to tell you to send it back to us - hassle free.

 

You received a full refund - why did you leave us a negative?"

 

My response was this:

 

"Why did I leave you negative feedback?

Are you serious about this?

 

First and foremost:

 

When I contacted you about receiving the wrong watch I was met with NO WHAT SO EVER understanding from you.

The final answer from you after many e-mails, photos and a description in detail that I got the wrong watch was, I quote:

 

"That is impossible as we checked and scanned the only SNDA61 we had.

We could not have mixed up the watches.

We only had one of these models and never sent anything else to you"

 

Second, you actually insinuated that I was lying about the whole thing "...never sent anything else to you" - I do not tolerate that! That alone was enough for me.

 

Third and last: This whole incident did cost me a lot of time & money. The shipping alone I payed almost 70 USD just to get the cheap Seiko you wrongly sent me in the first place back to you.

 

Do you still wonder why you got negative feedback from me?

 

Actually I would at least expect/demand an apology from you for wasting my time & money like you did."

Nice response! Couldn't have put it any better myself. Got to watch these dickheads who trade on eBay, so many time wasters, scammers and retards.
