I'm not sure but I think in Europe is illegal the act of selling counterfeits, not the act of buying for personal use. If it was, then whenever you purchase a fake without knowing, let's say a pair of fake Levi's, then you could be prosecuted, which it is just crazy. Next, the customs office can't report you to a private company, they should submit the case to a public court. If I were you, I would claim the watch to the customs.
