How close can a watch before plagarism?

So I was christmas shopping yesterday and popped into Argos. Whilst waiting for my purchase, had a look at the watches on display.

 

I noticed the latest Rotary watches look remarkably like my Brietling.

Hehe - we gave one of those away as a VIP prize earlier in the year. It's a nice watch for the dough although it's an old model, which is why Argos has them so cheap (they were about £120 originally).

 

It's pretty endemic. Most of the low-end manufacturers copy the high-end guys mercilessly. As you've seen, even respectable mid-range Swiss manufacturers such as Rotary produce homages to B&M, Breitling, Cartier, Chronoswiss, Breguet, Omega, JLC and others.

 

Go to any branch of any high street low-cost jewelers and you'll find more Rolex sub and datejust copies than you can count..

Yeah - Rotary makes a bunch of homages.

 

Trademark issues start when customers would become confused between the products.

 

Some companies take that too far (like when Rolex sued Invicta to make them change from a coin bezel to a scallop bezel on their sub homage).

 

I draw the line at the name and logo. To me; no name or logo = homage.

There's so many legitimate knock offs of the DJ and DD Rollies. Almost every 2nd tier Swiss watch company has made them.

It makes me laugh - on gen forums they talk about 'legitimate replications' like those detailed above, but if all you're doing is changing the name on the front, then how is that any different to repping something? lol

 

Once again, it is merely the 'faking' of implied brand values that those who dislike reps are getting hung up about (IMHO).
